Terms of Service

Virlya is an AI-powered platform for creating social media marketing content. The service includes: • AI-driven campaign generation (research, strategy, copywriting, visual creation) • Brief management and content approval • Social media integrations (Meta, LinkedIn) • Branding document and reference material uploads • Post scheduling and publishing Virlya is provided as Software-as-a-Service (SaaS) via a web application.

A contract between you and Virlya is formed by: • Completing registration and creating an account • Checking "I agree to the Terms of Service" at signup • Actually using the service The Terms apply to both individuals and legal entities. If you accept these Terms on behalf of a company, you represent that you have authority to do so.

• Access to the service requires registration and account creation. • You are responsible for maintaining the confidentiality of your login credentials. • You agree to promptly report any unauthorized use of your account to [email protected]. • Accounts may not be shared among multiple users unless agreed under an enterprise plan. • We reserve the right to suspend or terminate accounts that violate these Terms.

You agree not to: • Violate applicable laws or third-party rights • Distribute content that is unlawful, offensive, discriminatory, or misleading • Use the service to send spam or unsolicited communications • Attempt unauthorized access to Virlya's systems or other systems • Reverse engineer, decompile, or disassemble the platform • Use automated tools (crawlers, bots) without our prior consent • Sell, resell, or sublicense access to the service to third parties Violations may result in immediate account termination without refund.

• You are responsible for all content you upload or input into the platform (briefs, branding documents, texts). • You grant Virlya a non-exclusive, worldwide, royalty-free license to use your content solely to provide the service. • You represent that you hold all rights to the content you upload and that its use does not infringe third-party rights. • Virlya is not responsible for AI-generated content based on your inputs. You are required to review and approve all generated content before publishing.

• The Virlya platform, its source code, design, logo, and trademarks are the exclusive property of Virlya s.r.o. • AI-generated content based on your inputs: ownership of final outputs belongs to you as the user, except for third-party content used during generation (stock images, fonts). • You may not copy, modify, or distribute the platform without written consent from Virlya.

• Prices and subscription plans are listed on the Pricing page. • Subscriptions automatically renew unless cancelled before the end of the billing period. • Payments are non-refundable except as required by law or in case of a demonstrable error on our part. • We reserve the right to change prices with at least 30 days' prior notice. • Non-payment may result in account suspension or termination.

• We aim for 99.5% monthly platform availability but provide no guarantee of uninterrupted service. • We reserve the right to perform planned and unplanned maintenance. • We are not responsible for outages caused by third parties (Supabase, Meta API, OpenAI, etc.).

• Virlya is not liable for indirect, incidental, special, or consequential damages. • Our total liability to you is limited to the subscription fees paid in the last 12 months. • We are not responsible for decisions made based on AI-generated content. • AI-generated content is for informational purposes only and does not constitute legal, financial, or other professional advice.

• You may cancel your account at any time via Settings → Account. • Virlya may terminate or suspend your access upon breach of these Terms, generally with 14 days' notice (immediately for serious violations). • After account cancellation, your data is retained for 30 days and then permanently deleted, unless law requires longer retention.

• We reserve the right to modify these Terms at any time. • We will notify you of material changes by email at least 14 days before they take effect. • Continued use of the service after changes take effect constitutes acceptance of the new Terms.

• These Terms are governed by the laws of the Czech Republic. • All disputes will first be addressed amicably. If unsuccessful, the courts of the Czech Republic have jurisdiction. • EU consumers have the right to out-of-court dispute resolution via the European Commission's ODR platform.
